Sentencing Delayed For Ex-Coach, Lion In Sex Case

MOUNT CLEMENS (WWJ) - Sentencing for ex-track coach and former Detroit Lions player Tommie Boyd has been put off for a week until sentencing guidelines can be settled.

The 39-year old Boyd pled guilty last month to second-degree sex charges in a 2009 case involving a then-15-year-old freshman female at Fraser High School.

Defense Attorney Randy Secontine says the guideline is still based on more serious first-degree charges that were dropped.

"It appears that there are significant discrepancies in the report, primarily to the scoring of the sentencing guidelines," Secontine said.

Boyd's probation officer, however, was sticking to her report.

"According to the police report, there was sexual penetration.  I understand that he pled to CSC Second (Degree), but we don't take a plea agreement into consideration. We take the actual offense into consideration," she said.

Macomb County Circuit Court Judge Diane Druzinski noted that quite a few rulings recently have coming down from higher courts concerning sentencing guidelines.

The judge ordered all parties to do research and file memoranda next week at Boyd's rescheduled sentencing, set for Thursday, March 3.
