Court Turns Down Appeal In Dispute Over Police Video

LANSING (WWJ/AP) - Michigan State Police may be forced to pay a penalty for not turning over a patrol car video fast enough.

The state Supreme Court has let stand a lower court ruling in an unusual lawsuit involving the Freedom of Information Act. An Ionia County woman sued state police after they failed to turn over traffic stop video in a timely manner.

State police wanted the lawsuit dismissed, saying Nancy Prins missed the 180-day deadline to sue. But the appeals court says the clock starts running when a FOIA denial is postmarked, not when a denial is created.

The Supreme Court heard arguments but decided last week to stay on the sideline. Chief Justice Robert Young Jr. was the lone dissenter.

It's possible state police could have to pay Prins a financial penalty.
