Super Summer in the D Giveaway OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.
1. HOW TO ENTER
a. The Super Summer in the D ("Contest"), being conducted by WXYT-FM (the "Station") will begin on June 28, 2012 at approximately 7:00 a.m. Eastern Time ("ET") and end on September 7th, 2012 at approximately 11:59 p.m. ET ("Entry Period").
b. To participate in the Contest, you may enter via the following method(s):
1) TEXT: To enter the Contest by text message, visit any one of the Rite Aid locations listed below (last page) during regular business hours during the Entry Period to receive the special text code ("Short Code"), and text the Short Code to 97136 during the Entry Period. The Station is not responsible for telephone service outages, delays, equipment malfunctions and any other technological difficulties that may prevent an individual from sending a text message. Message and data rates may apply, and the Station is not responsible for any fees incurred by an entrant for this method of entry. By entering by text, you consent to receive a confirmation text message from the Station.
OR
2) MAIL IN: 3"x5" INDEX CARD ENTRY FORM: To enter by mail, legibly hand write your first name and last name, complete address, city, state, zip code, telephone number (including area code), and date of birth on a 3"x5" card or piece of paper. Mail the completed entry form with sufficient first class postage to "Super Summer in the D" c/o 97.1 The Ticket, 31555 W. 14 Mile Road, Ste. 102, Farmington Hills, MI 48334. Mail-in entries must be postmarked by Friday, September 7, 2012 and received by Tuesday, September 11, 2012 regardless of postmark date. Only one (1) mail-in entry per outer mailing envelope is permitted. Entries submitted may not be acknowledged or returned. The receive date for all mail-in entries shall be determined by the Station in its sole discretion, which shall be final and binding.
b. Entries submitted will not be acknowledged or returned. No mechanically reproduced, illegible or incomplete entries will be accepted. Contest entries will be deemed null and void and will be rejected if not submitted through authorized, legitimate channels. If a dispute as to the identity of any entrant (text or mail-in) cannot be resolved to Station's satisfaction, the entry will be deemed ineligible. Proof of submission of an entry shall not be deemed proof of receipt by Station. The Station is not responsible for lost, misdirected, illegible, incomplete or late entries or entries that are defective or unreadable, or entries not received due to any other difficulties regarding the entries.
2. ELIGIBILITY RESTRICTIONS
a. The Contest is open to all residents of the state of Michigan who possess a valid government-issued picture ID, and are 21 years of age or older at the time of entry. Employees of the Detroit Tigers and MillerCoors, Rite Aid (collectively "Sponsors"), the Station, its licensee, the licensee's parent, subsidiary and affiliated entities, Station's advertising and promotional agencies, its participating sponsors, other radio stations in the Detroit metropolitan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.
b. Persons are eligible to win a prize valued over $50 (or ticket prize valued over $100 per ticket) in a Promotion conducted by the Station only once every thirty (30) days and only once every six (6) months if the prize is valued over $600. Only one (1) winner per household is permitted in any Station promotion.
c. Each winner must provide valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize.
d. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements. The Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children's Online Privacy Protection Act.
3. PRIZES
a. Ten (10) Qualifying Prizes will be awarded. Each Qualifying Prize includes two (2) Passes (for winner and one (1) guest) for a behind-the-scene tour of Comerica Park on Monday, September 24, 2012 at TBD. The tour includes a visit to the dugout, and the broadcast booths. Tour will take place on September 24, 2012 (the tour of Comerica Park will be referred to as the "Qualifying Prize Date"). Qualifying Prize winners will also be eligible for a chance to win a Grand Prize in a drawing conducted after the tour. Approximate Retail Value ("ARV") is $12.00. Game tickets are not included.
Four (4) Grand Prizes will be awarded. Each Grand Prize consists of two (2) tickets (for winner and one(1) guest) to see the Detroit professional baseball game at Comerica Park in Detroit on Thursday, September 27, 2012 in a Suite. The ARV of each Grand Prize is $199.
Prize is subject to availability. If the winner cannot attend on dates specified by the Station, the winner may be disqualified and an alternate winner may be selected in the Station's sole discretion. All other costs not specifically stated herein, including but not limited to those of, taxes, meals, tips and ground transportation to/from the Park, and parking are the responsibility of the winner.
If a selected Grand Prize/Qualifying Prize-related event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Station, the Station's sole responsibility to the winners will be to award the remaining available portion of the prize and no substitution or compensation will be provided for the unawarded portion of the Grand Prize/Qualifying Prize.
Qualifying Prize certificates must be picked up during regular business hours at the office of the Station at the address listed below. Qualifying Prize winners will forfeit any prize or prize certificate not claimed by 5:00 pm on Friday, September 21, 2012 or the prize will be forfeited and an alternate winner may be selected in a random drawing from all remaining eligible entries (time permitting). Grand Prize winners will forfeit any prize or prize certificate not claimed at Comerica Park the day of the tour.
b. There are no substitutions, transfers, or cash equivalents for prizes, except that Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. SELECTION OF WINNERS
a. Decisions of the Station management with respect to the Contest are final.
b. On September 11, 2012, ten (10) potential Qualifying Prize winners shall be selected by the Station in a random drawing from all valid text and mail-in entries received. Each potential Qualifying Prize winner will be notified by phone by the Station following the Qualifying Prize winner drawing.
c. At the end of the Qualifying Prize tour, the Station will select four (4) Grand Prize winner through a random drawing from the ten (10) Qualifying Prize winners present on that respective Qualifying Prize Date. If qualifiers do not show up for the tour or not enough qualifiers to participate in the tour, then the station will pick from the other entries randomly and a winner will be selected. The Station will notify the Grand Prize winners on-site following the Grand Prize winner drawing. A maximum of four (4) Grand Prize winners will be selected at the Qualifier Prize Date.
d. Entrants need not listen to the Station nor be present to win a Qualifying Prize. Qualifying Prize winners need not listen to the Station but must be present at their Qualifying Prize Date to be eligible to win a Grand Prize.
e. Qualifying Prize winners must execute and return any required affidavit of eligibility and/or liability/publicity release by September 21, 2012 or prize will be forfeited and Stations may elect not to award the prize to an alternate winner. Grand Prize winners must execute and return any required affidavit of eligibility and/or liability/publicity release the day of winning or as otherwise directed by Station at the time of notification or prize will be forfeited and Stations may elect not to award the prize to an alternate Grand Prize winner. Prize(s) will be awarded only upon confirmation of eligibility and completion of all requisite releases. If a potential contestant or winner cannot be contacted, fails to sign and return the required fully-executed affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner's full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station's market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.
b. By participating in the Promotion, the winner agrees to have the winner's name, voice and likeness used in any advertising or broadcasting material relating to the Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Promotion winner (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Station, its licensee, the licensee's parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.
d. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate or modify the Promotion. If the Promotion is terminated before the original end date, the Station reserves the right to select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date or otherwise modify the procedure for selecting winners.
e. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station's website. Failure to comply with the rules of the Promotion may result in a contestant's disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Station reserves the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.
f. The Station reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Promotion and shall not be required to award a substitute prize.
g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.
c. For the Official Rules, send a self-addressed stamped envelope for receipt by September 7th, 2012 to "The Super Summer in the D – Official Rules" c/o 97.1 The Ticket, 31555 W. 14 Mile Road, Ste. 102, Farmington Hills, MI 48334. For the names of the prize winners send a self-addressed stamped envelope for receipt by September 31, 2012 to "The Super Summer in the D – Winner List" at the above address. Official Rules and Winner Lists (when completed) shall also be available during regular business hours at the main offices of the Station.
