Cipriano Pre-Trial Canceled; Judge Not Going On The Record Says Clerk

PONTIAC (WWJ) - A pre-trial hearing in the case of 19-year-old Tucker Cipriano -- accused in the baseball bat murder of his own father -- was unexpectedly canceled Tuesday. Cipriano and co-defendant, 21-year-old Mitchell Young, were to appear in Oakland County Circuit Court.

But at the last moment attorneys were called into Judge  Shalina Kumar's chambers and the hearing was canceled.

"The judge actually handled this in chambers today - so we are not going to be going on the record," said the court clerk.

After Cipriano's attorney, Mitchell Ribitwer said there are issues still to be debated in the file in June is the admissibility of crime scene photos some of which he plans on challenging.

"It would create prejudice with respect to our clients receiving a fair trail - they are very graphic, blood spatter - injuries to Mr. Cipriano - injuries to Mrs. Cipriano," he said.

Both Cipriano and Young are charged with murder in the April 16 beating death of Robert Cipriano in the family's Farmington Hills home.
