Mich. House OKs Bill Against Indefinite Detention

LANSING (AP) – The Michigan House has approved legislation that would prohibit state and local law enforcement officials from helping the federal government indefinitely detain American citizens without charges.

The state legislation passed unanimously Thursday would bar active duty Michigan National Guard members from helping to detain citizens indefinitely. A similar bill has passed in the Senate.

The bill is a response to a provision in the National Defense Authorization Act that allows the indefinite detention of some terrorism suspects, which civil liberty activists say is unconstitutional.

Republican Rep. Tom McMillin of Rochester Hills says the bill does not interfere with federal law because it only bans local officials from assisting in indefinite detention, not from carrying it out.

The bill now heads to the Senate.
