3 Charged After Photo Of Sex Act With Teen Girl Appears On Twitter

SHELBY TOWNSHIP (WWJ) - Three Macomb County teenagers are facing felony charges after two of them allegedly engaged in a sexual act with a 15-year-old girl and the other photographed it.

The Sheriff's department alleges that Gregory Kwapik and Nicholas Kelly, both 17 years old, engaged in an unspecified sex act with the girl, while Ryan Modaffare, also 17, snapped a photo.

The picture was sent to others and eventually ended up on Twitter. That's when Sheriff Anthony Wickersham says authorities were made aware of the crimes.

The sexual activity took place at the girl's home sometime around Thanksgiving, according to authorities. Following an investigation, Kwapik, Kelly and Modaffare were arrested on Dec. 30.

Kwapik and Kelly are both charged with third-degree criminal sexual conduct, a 15-year felony. Modaffare was charged with child sexual abusive activity - distributing or promotion, a seven-year felony.

The three, all Chesterfield Township residents, were arraigned Tuesday in 41A District Court in Shelby Township and are being held on a $100,000 bond.

All involved are students at L'Anse Creuse North High School in Macomb Township.

Wickersham says this is another cautionary tale.

"What we see is sometimes these students, you know, just aren't thinking; and whether they think it's going to be a joke or they're doing it for a vindictive reason...once they take that picture of a minor and start sending it around, they are committing a felony," Wickersham said.

The next court date in the case is set for Tuesday, Jan. 20.
