Homeowner Won't Face Charges After Killing Break-in Suspect

MENOMINEE, Mich. (AP) - Authorities say a homeowner in Michigan's Upper Peninsula won't face charges after he fatally shot a 19-year-old man who was among three men breaking into his home in November.

WLUK-TV and the EagleHerald report the Mellen Township homeowner is expected to testify at upcoming hearings against the two surviving suspects. The Menominee County sheriff's department earlier had said the shooting was in self-defense.

Prosecutor Daniel Hass says her "did not seek out or confront the perpetrators. He waited to shoot until the perceived danger to himself entered his home."

The homeowner opened fire after hearing the men breaking in and calling 911. Authorities found Hayden Gagnon of Pulaski, Wisconsin, dead at the scene with multiple gunshot wounds. They captured the two other men in the woods near the home.
