Man Accused Of Taking 'Up-Skirt' Photo Of Woman At Ice Cream Shop Charged With Felony

WESTLAND (WWJ) - A Garden City man accused of taking an "up-skirt" photo of a woman at Westland ice cream stand last week was arraigned on Monday.

Police testified that 45-year-old Arthur McCauley walked up behind the woman, at Mickey's Dairy Twist on Cherry Hill Road, bent down, and snapped the picture as the woman was distracted by her three kids.

The victim's brother allegedly saw what happened and tried to get the man's phone, but he just walked away.

Police said anonymous tips and Facebook chatter helped investigators track McCauley down.

Hoping for a low bond, defense attorney Mark Haidar told 18th District Court Judge Mark McConnell his client is not a flight risk.

"Once he realized that the authorities were investigating the matter, he called them," Hadair said. "So I don't think you'll have any worries, your honor, that he'll appear."

McCauley faces on felony count of using a computer to commit a crime, and one count of capturing an image of an unclothed person — which includes a person in his or her undergarments.

The judge set bond at $10,000/10 percent, cash or surety — with conditions. McCauley won't be allowed to have any cameras or recording devices if he's released.

McCauley is due back in court on Thursday, July 16 for a probable cause hearing.
