Man Faces Jail After Not Informing Live-In Girlfriend Of HIV Status

EASTPOINTE (WWJ) - An HIV-positive man is facing jail time after admitting to having sex with his girlfriend without informing her about his status.

Daryl Sample, 34, is set to be scheduled March 1 after pleading guilty last month to one count of sexual penetration by a person infected with AIDS or HIV, a four-year felony. In exchange for his plea, prosecutors dropped charges of larceny and unlawful driving away of a vehicle.

Sample's attorney told the Macomb Daily that his client just "wants to move on with his life" and is seeking probation. Sentencing guidelines range from probation to nine months behind bars.

Police say the woman, also 34, found out about Sample's HIV status in June 2013 after looking through paperwork at their home on Schroeder Avenue, in a neighborhood along 9 Mile and Kelly roads in Eastpointe.

Years after the woman filed her complaint, Sample was arrested and charged in December 2015.
