Van Driver Faces Circuit Court Arraignment In Buggy Crash

BEAVERTON TOWNSHIP, Mich. (AP) - A mid-Michigan man will be arraigned in Gladwin County Circuit Court in a crash with an Amish buggy that killed a 31-year-old woman and injured her three children.

The Bay City Times reports Wednesday that 58-year-old Kevin Toner, of Coleman, has waived his right to a preliminary examination in district court.

Toner is charged with operating a motor vehicle under the influence causing death. Court records say he was under the influence of THC, the psychoactive chemical in marijuana.

Sarah Stutzman of Clare County died at the scene on Dec. 14 in Beaverton Township, about 125 miles northwest of Detroit. The horse-drawn buggy was rear-ended.

Toner and a passenger in his work van were not injured.

Toner is scheduled for arraignment Monday in circuit court.
