'Birthday Cake Kicker' Gets Probation In Kroger Incident

ROYAL OAK (WWJ) - A Bloomfield Hills woman accused of drop kicking a birthday cake at a Kroger grocery store has been sentenced  on a charge of disorderly conduct.

Tricia Kortes appeared in 48th District Court Thursday where she was sentenced to 300 hours of community service, 12 months of probation and a $500 fine.

The charge stems from an incident that happened June 11 at the Kroger store on Telegraph Road in Bloomfield Township. Kortes was apparently unhappy with the way a custom-decorated birthday cake for her 7-year-old son turned out, so she went behind the bakery counter, drop-kicked the cake and then stomped on it, according to police. She left the store without paying for the cake.

"I apologize for my actions at Kroger," Kortes told the court. "I'm truly embarrassed by my conduct."

Judge Kimberly Small chided Kortes' actions, saying she seems to throw a "temper tantrum" when she doesn't get what she wants.

"What concerns me is that something as trivial as a design on a cake literally threw you into a tizzy," said Small. "If I was shopping with a child, I'd be horrified. And quite frankly, I think the child would be horrified, too."

Separately, Kortes is charged with assault and battery over an incident that happened at Ray's Ice Cream in Royal Oak on July 9, 2015. In that incident, she's accused of striking an employee on the head because the shop was out of her favorite flavor — Mackinaw Island Fudge. She's due back in court in October.

Kortes has also had at least two other similar run-ins with the law and was ordered to attend anger management classes, which her attorney says she successfully completed.
