Court: Club Not Liable In Indecent Exposure Case

A man wrongly charged with exposing himself at an East Lansing health club can't sue the business for negligence and defamation.

The Michigan Court of Appeals said it was law enforcers who decided to charge David L. Wilson, not the Michigan Athletic Club.

Wilson was charged with indecent exposure at the swimming pool in 2006 after the club's executive director reported his suspicions to police. But another man later confessed, and the charges against Wilson were dropped.

The appeals court said Wednesday that holding the club liable would have a chilling effect on people who report allegations of criminal activity. A message seeking comment was left for Wilson's lawyer.
