Attorney Sues To Find Out Mayor's Age

WARREN (WWJ) - How old is the mayor of Warren? An attorney thinks we need to know, and for good reason. But the mayor is keeping mum.

A local attorney is suing to force the city to clarify Mayor Jim Fouts' date of birth, claiming his "personal aversion" to revealing his age could be against the law.

Attorney Arthur Garton said the city of Warren failed to respond on time to a Freedom of Information Act request on the matter and once it did, all of that personal information had been deleted.

Garton is now seeking a court order in Macomb County Circuit Court that would require the city to release the information. 

Records with the Michigan Secretary of State show Fouts is 66-years-old.
But the state education department shows Fouts, a former teacher, is 68-years-old.

Fouts told the Detroit News that Garton's law partner has filed paperwork to run for Fouts' mayoral job.
