Porn In Prison Lawsuit Dismissed

DETROIT (WWJ) - A convicted bank robber with a long history of frivolous lawsuits, has lost his suit to get access to pornography while being held in a county jail. WWJ's Rob Mason reports on the decision to dismiss the lawsuit.

A federal judge dismissed the lawsuit this week because Kyle Richards didn't pay the $350 filing fee. Richards sued state officials in June while being held in the Macomb County jail, where pornography is not allowed. He subsequently pleaded guilty to bank robbery and was sentenced this week to at least three years in prison.

Richards said that the denial of erotic material was cruel and unusual punishment - ironically Richards may get his wish, as long as it's not violent, the state does allow some sexual material in state prison.
