Toy Guns Becoming A Criminal Offense?

DETROIT (WWJ) – State lawmakers are currently reviewing legislation that targets the use of certain toy guns. A planned proposal before the Senate would make it a crime to possess a toy gun that has its required markings removed or by having a real gun that is made up to look like a toy.

State Senate Republican Rick Jones said that this has become a major problem, especially within the gang community. “People are taking imitation firearms that look real, cutting off the orange end and then threatening people,” he said.

Supporters of the proposed legislation have also cited a recent case where a police officer was forced to shoot a gang member who was aiming a toy gun without its required markings. Jones believes this proposal will be vital in preventing incidents such as this from occurring in the future.

“This is an important package to control this problem,” Jones said.

If the legislation is passed, people who possess these toy guns and use it to commit a felony, would be punishable for up to 18 months behind bars and be subject to fines.

    This legislation will have NO effect on people doing stupid things. IF you modify a toy gun to look like a real gun, then point it at a cop, you deserve to be shot. What will the state do then, charge the dead bad-guy with a misdemeanor?

    None-the-less, the legislation should be passed for those incidents that don’t end in tragedy.

    This silliness reminds me of buildings with decals on the doors saying no guns allowed. That’s as dumb as the day is long.

    Law abiding citizens will obey the decals, the criminals won’t. So you have a scenario where a criminal is engaged in crime using a firearm, yet the law abiding citizen who may have a concealed-carry permit is unable to offer life-saving assistance.

    When I was in high school back in the 80′s – Gunsmithing was actually an elective…you see we didn’t have kids shooting eachother in school…oh and there was 1 pregnant girl in our whole highschool of about 1200 kids. When my brothers were little – they played with real revolvers that dad modified so it was not possible to actually fire them. Man those were good times.

    If people wont give up their real guns that they have illegally, what will this do?

    The only thing anyone can do to fix Detroit is to stop giving people money for not working. This problem is in the unions and government. Being from Farmington I can tell you everyone in lower Michigan knows the unions killed manufacturing in Michigan, they just cost too much for a company to afford. If I was wrong Toyota and BMW (probably more but im not writing a research paper) would not profitably be building cars all over the US right now. Lets segue back to the original point, a job is probably the best remedy for real gun problems so instead of acting busy talking about fake guns maybe they should get busy taking power away from the unions and putting people back to work.

    When I was a child, the police had no problems distinguishing between toy guns and real ones. I had a Luger squirt gun and a M-3 submachine cap gun. We had a shooting range in our high school basement. Real firearms were routinely carried on school buses on their way to shop class where they would get new stocks, new bolts, firing pins, etc.

    But that was when America was a free country.

    This proposed law is just another good reason to stay out of cities.

    The only real question is, What happens when the city government is reduced to asking a population of parasites to support a population of parasites? A federal bailout is the only possible answer, so we’ll see whether Obama thinks Detroit is “too big to fail.”

President Obama took away the voucher program in Washington DC after one week in office. I guess he did not think that poor kids with good grades should go to schools with his children. Detroit there is another kind of bias and predjuduce today and it is an elite academic few who think that they can make decisions that will keep us poor and uneducated, while protecting the priveleged elite rulers and the politically connected class. Wake up, Detroit, stop being used, vote Republican and be lifted out of poverty.

    So I simply told him that I had thought that trough and came to this conclusion.

    True story: A few years ago where I live, a couple street thugs burst into a Wallgreens carrying a 12 gauge shotgun. A patron was in line happened to be carrying a concealed weapon. He handled the matter, and killed the thug carrying the shotgun. The other one ran, but was later apprehended.

    By the way, I’m pretty sure that robbery is a crime already, I don’t think a toy gun law is going to stop a criminal from committing a crime. Same with banning real guns…the only ones who have them then are the criminals.

If there were more law-abiding citizens who CCW, when they tried to hold up someone using a toy gun, they would be shot and killed. Problem solved. Percentage of repeat offenders: 0%.     Having laws that apply higher penalties to, for example, using a gun to rob a store is no problem. A robber could do more damage with a gun than not a gun.

    IF the laws were written to SPECIFY “posessing a firearm in comission of some larger cime” then that would be great.

    But heres where the traitorous anti gun agenda (both Liberal AND CONservative) comes into play – they “conveniently” leave off the part about “in the context of some other crime.

    That plays into the un Constitutional anti gun agenda as it can then be used to infringe on Citizens Rights to Bear Arms on some flimsy excuse of “might do something”

Gang members tend not to follow laws haha, why would gang members pay any heed to this? They are already committing robbery! Wow.     I’m from a city outside of Detroit. We have been asking them this question for decades. Well, here’s the answer. They vote all the left loons in and when everything falls apart they cry to Lansing for money to get out of trouble. Lansing always pulls them out. When you ask our state legislators why they do this, they tell us that Detroit is too important to fall. No one in Michigan wants riots or trouble in the streets ever again. So, blackmail would be the answer. Don’t expect them to vote for Republicans because Detroit does not want to loose control over the state of Michigan.

    A lot of cops are pretty much useless, though, ya know? And some of them are worse-than-worthless and potentially dangerous nutjobs who should never have been allowed to carry a gun and badge.

    They’re good for revenue generation by order of their bureaucratic masters, though, by way of pick-pocketing commuters going ten-over on the freeway on their way home from work.

    Rarely a “peace keeper” around when someone might need one, though. And even then, they show up too late or sit outside the danger-zone until their “protocol” tells them it’s safe for them to “secure the premises.” Usually 40 minutes after all the damage is done.

    I think your buddy is a BS artist.. First off it isn’t a citation offense and second weapons (basically excepting pistols and “assault rifles”, and other illegal to own items) that are in plain view can be carried in vehicles. And bats aren’t considered weapons unless modified in certain ways and/or used as a weapon. But what do I know I live in CA. Anybody who got his legal training off anything better than a crackerjack prize could win that one.

    This is just the legislators’ admissions that they have failed miserably to fix the problem of gangs in this country. For the most part, efforts made by legislators to stop gangs is – just like this one – aimed at the law-abiding public. For anyone to assume that such a law would make even the least dent in gang behavior is beyond the pale of ignorance – but, then, we have legislators demonstrating their ignorance daily.

    No! The solution can only come about when the entire criminal justice system as it has come to be is dismantled and reassembled. The entire system today exists to support those who participate in it, not to decrease crime and improve safety for law abiding citizens. Ask yourself, how many lawyers would have to find other work if criminal recidivism were reduced by 90%? How many judges? Parole officers? Social workers? Policemen? Judges? By how much would the tax burden be reduced to say nothing of the reduction in crimes against property and persons? The problem is the damned fools who cannot or will not fix the system.

    Excellent point about cops having become civic revenue generators by enforcing laws in which there is no victim. How much do you suppose communities rely on fines and fees generated by victim-less crime?

    Here’s an idea: How about passing a law requiring CPA’s and the firms they work in to come up with ‘generally accepted accounting principles’ for reporting such information (and a ton more). Then let us mandate that every community with any authority to make or enforce laws be required to track and post the information on their websites in prescribed forms so that John Q. Public can go out and do comparative analysis about the community that taxes him.

    The Internet makes possible many things that could never have been done before. Our lawmakers waste their time trying to outlaw toy guns to avoid gang violence (as if) instead of focusing on simple things that would benefit the populace. But, perhaps, legislatures are meant to harangue and harass the communities they serve as posited by Orwell.

    In other news the Democrat controlled Detroit city council has outlawed “Strike Anywhere Kitchen Matches” after discovering, as the council President stated,”You can strike these matches ANYWHERE and start a fire! It even says so on the package. What they don’t tell you is you don’t even have to be in the kitchen!”
    The council released a statement supporting the measure claiming,”If it stops even one unintended fire it will be worth it.”

    Later today a measure will be voted on to require all scissors be made of rubber as children could hurt themselves running with metal ones. Also in the name of hygiene a law was passed declaring all underwear must be changed three times a day. In compliance with the law underwear is to worn on the outside so inspectors can more easily check.

All fully and semi automatic toys need to be regulated. if we require a similar license like Illinois to buy ammunition for caps and plastic darts and plastic BBs when can regulate the toy gun industry and prevent future problems.     Having been a citizen of Detroit once and knowing the culture, what does a cop do when a drug gangster hires a 6 yr old to shoot anyone including cops while he sells drugs in the street… knowing cops will hesitate to shoot a 6 yr old. We are fortunate that drugs makes you stupid and the gangsters have not thought about painting the end of the barres to look like toys.
    Thags, I fail to see your logic for police to not defend themselves from being shot by the 6 yr olds in Detroit.

    My God! Is this what America has become? You crank up the entire legislative machinery of a State to deal with an imaginary problem with toy guns? The entire process is geared to solving the non-problem of gang members taking an orange tip from a toy guns, pointing it at a cop and being killed (hopefully) ? Doesn’t the gang-memeber deserve to take some responsibility for his own death? Does one really think that yet another law will stop some one who is so stupid as to point a realistic toy gun at an obviously really armed cop from taking an orange tip off? This is so sad on so many levels I really despair. Are we to pass a law for each and every open and obvious form stupidity takes?

    Don’t get me wrong here, but when I first saw this on my friend’s profile, I understood perfectly the logic behind this idea. When other people use toy guns to mess around, and then later threaten a person’s life, there should be some investigation before sending the person to jail, but it is still a high level of evidence. That constitutes the fact that when a mother uses a toy gun with her eight year old child, and then that child ends up dead, that the heart of it is probably the mother or the one who found the gun afterwards. When it comes to a child messing around with a gun, then I do not think there should be nearly as much time in jail as the older person (depending on how old the child is). You have an eight year old, I don’t know if they are mentally aware or not, but it depends. Common sense is a good artifact of character.

    This has been the primary problem with the anti-gun liberals. They believe by eliminating gun ownership, they will eliminate killings. The problem is that the criminal doesn’t adhere to the law, and can easily obtain guns, as they do illegal drugs.

    so the 6 year old picked up his brothers real gun when brother was zonked out of his mind on crack. The cop knowing of all the shootings is NOT going to take a chance and I am supporting the cop. to a 6 year old death is not so real as they see cartoon characters shot on tv with holes in them and still run around. sure the poor kid did not mean to shoot the cop but he did – so what is better dead cop or dead kid???

    Has common sense been lost in this country? Honestly outlawing toy guns. If a perp/criminal is using a toy gun to commit a crime, well then charge him as if he was using a real gun and treat the situation as such. The intent is still there from the criminal. No, but lets make some toy guns illegal! What is going to be next? Plus for those extremists, no that doesn’t mean to shot a kid who is playing or pretending to point a toy gun at a Police Officer or Citizen!
    Everyday and every media article I see/read this wonderful country is doing a rapid descent into the depths of a Socialistic and Nanny State!

If you read these comments you would think it happens every day. What are the actual numbers? I’ll bet the number is zero. I suspect what we have here is another cowardly, pandering politician with a cure in search of an ill. I think we would all be better off if this jacka$$ would stick to actual problems rather trying to get his name in the news with garbage like this and the passage of more stupid laws which are a bane to our personal freedoms. That is about the ONLY thing that the government is doing that is constitutional – military and law enforcement are constitutional. Now, of course there are many LAWS that are NOT constitutional.
