1. HOW TO ENTER
a. The Stoney and Bill Wiffle Ball Challenge Contest (the "Contest") begins on December 7, 2012 at 12:00 AM Eastern Time ("ET") and ends on December 10, 2012 at 10:00 AM ET (the "Entry Period"). The Contest shall be administered by WXYT-FM, 26455 American Drive, Southfield MI 48034 (the "Station").
b. Entrants may participate in the Contest by registering online or by mail-in entry by mailing a 3"x5" card as follows:
1) ONLINE ENTRY: To enter via online registration, visit http://detroit.cbslocal.com/station/97-1-the-ticket during the Entry Dates and click the contest entry button to connect to the contest registration page. Each entrant must fully complete the online registration page with all required information including his/her name, complete address, valid email address, year of birth, and phone number(s) (including area code(s)). After having read and agreed to these Official Rules, click the submit button to submit your online entry. All online entries must include all required information and must be received during the Entry Period be eligible for a chance to participate in a Qualifying round (defined below). Limit one (1) online entry per person or email address regardless of method of entry and regardless if entrant has more than one email address. Multiple participants are not permitted to share the same email address. Any online entry submitted with an invalid email address will be disqualified. Entries submitted will not be acknowledged or returned. Use of any device to automate entry is prohibited.
2) 3"x5" INDEX CARD ENTRY FORM: On a 3"x5" card or piece of paper, legibly hand print your full name, complete address (including city, state and zip code), daytime phone number (including area code), e-mail address (if any), and date of birth; and mail it to "Stoney and Bill's Wiffle Ball Challenge" c/o 97.1 The Ticket, 26455 American Drive Southfield MI 48034. All mail-in entries must be RECEIVED by the Station by Monday December 10, 2012 at 10:00am. Entrants must allow sufficient time for postal delivery. The receive date for all mail-in entries shall be determined by the Station in its sole discretion, which shall be final and binding. Limit one (1) online entry per person or email address regardless of method of entry. Only one entry is permitted per outer mailing envelope. Entries submitted will not be acknowledged or returned. No mechanically reproduced, illegible or incomplete entries will be accepted. Contest entries will be deemed null and void and will be rejected if not submitted through authorized, legitimate channels. If a dispute as to the identity of any entrant (online or mail-in) cannot be resolved to Station's satisfaction, the entry will be deemed ineligible.
2. ELIGIBILITY RESTRICTIONS
a. The Contest is open to all legal residents of the state of Michigan who possess a valid government-issued picture ID, and are 21 years of age or older at the time of entry. Employees of the Detroit Tigers, the Station, and the Station's licensee (collectively, "Contest Entities"), and each of their respective parent, subsidiary and affiliated entities, Station's advertising and promotional agencies and participating sponsors, other radio stations in the Detroit Arbitron Metro, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Contest is subject to all applicable federal, state and local laws and regulations and is void where prohibited. Entrants are responsible for complying with these Official Rules.
b. Winners must meet all eligibility requirements to receive any prize package. The winner may be required to present valid government-issued photo identification and must provide their complete address, date of birth and phone number to claim a prize.
c. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements and will also delete any entry as required by law.
3. PRIZE
a. One (1) Grand Prize: a trip for two (winner and guest) to Lakeland, Florida for the Detroit Tigers Fantasy Baseball Camp on either January 20-27, 2013 or January 27-February 3, 2013. Trip includes round trip coach class airfare for two (winner and guest, 21+) from Detroit, Michigan to the greater Lakeland, Florida area; airport transfers to and from Florida airport; standard double occupancy hotel accommodations (one room) for 8 days / 7 nights; batting practice at Comerica Park before camp and during the season; meals in the Tigertown cafeteria; personalized authentic home and away Detroit Tigers uniforms (yours to keep); games in Tigertown every day; a "Fantasy Game" with former Tigers greats at Joker Marchant Stadium; a personal clubhouse locker for the week; and "Photograph Day" and "Autograph Night" opportunities. Grand Prize Approximate Retail Value ("ARV"): $6,990.00.
b. Grand Prize will be awarded, and must be accepted, on December 11, 2012 at the conclusion of the Contest. Certain travel restrictions may apply. Travel arrangements must be made through the Station or its designee. Prize is subject to availability. If the winner cannot travel on date(s) specified by the Station, the winner may be disqualified, and an alternate winner may be selected (time permitting) at the Station's sole discretion. All other costs not specifically stated herein, including but not limited to those of, taxes, meals, tips and ground transportation to/from the airport and/or to/from the hotel, are the responsibility of the winner. The winner and guest(s) must travel on the same itinerary and are responsible for obtaining all required travel documents, including, without limitation, passports for international travel. If applicable, the winner may be required to present a valid credit card upon hotel check in to cover any incidental expenses incurred during the winner's stay. The winner and guest(s) must sign a Publicity, Liability Waiver and Travel Release form prior to traveling. If a prize-related event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Contest Entities, their sole responsibility to the winner will be to award the remaining available portion of the prize and no substitution or compensation will be provided for the unawarded portion of the prize.
c. No more than the total number of prizes specified in these official rules will be awarded. All prizes or prize certificates may be claimed at the office of the Station at the address below during regular business hours. The winner will forfeit any prize or prize certificate not claimed by December 11, 2012. Forfeited prizes become the property of CBS Radio Inc. In the event that a prize or prize certificate is mailed or shipped to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.
d. Prize is not transferable, and no substitution, assignment, or cash equivalent of prize is permitted, except by the Station (solely at its discretion), which reserves the right to substitute a prize or prize portion with another prize or prize portion of greater or equal value. The prize(s) are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses. Station is not responsible for winners' limitations that prevent acceptance or use of prize. Entrants acknowledge that the Contest Entities have not made, nor are in any manner responsible or liable for, any warranties, representations or guarantees, and hereby disclaim any and all warranties expressed or implied, in fact or in law, whether now or hereafter enacted concerning any prize, including without limitation, implied warranties of quality, merchantability, mechanical condition, or fitness for a particular purpose, except for any express manufacturer's warranty as may be included with the prize or as may be separately provided to participants by law. Other restrictions may apply.
4. SELECTION OF WINNERS
a. Decisions of the Station management with respect to the Contest are final.
b. On Monday, December 10, 2012, three (3) potential qualifiers shall be selected by the Station in a random drawing of all valid entries received. Each qualifier shall be invited to participate in the Stoney and Bill Wiffle Ball challenge, a wiffle ball contest, on December 11, 2012 between 12:00pm and 2:00pm at Inglenook Park on 20901 W. 12 Mile Road, Southfield, MI, 48076 (the "Appearance"). Qualifiers must sign in at 11:40am and be present at the Appearance to be eligible to compete to win the grand prize. Qualifiers must sign participation releases to participate at the Appearance.
c. During the Appearance, the three (3) qualifiers will be required to attempt to hit a wiffle ball ten (10) times from behind the designated line at the park at Inglenook Park in Southfield. Stoney and Bill from the 97.1 The Ticket Morning Show will be pitching the balls. The qualifier with the longest hit out of ten hits as solely determined by the 97.1 The Ticket Morning Show will win. All three (3) qualifiers will have the opportunity to hit the ball ten times. Their longest shot will be the only on that counts for each qualifier. Only the longest shot will be marked with a flag. Accordingly, qualifiers who are not successful in making a long shot in their initial attempt should not leave the Appearance until all qualifiers have gone in their initial attempts. If two tied qualifiers miss, the tied qualifiers will have the opportunity to make a second attempt to shoot until someone makes the longest shot.
d. A maximum of one (1) Grand Prize winner will be selected at the Stoney and Bill Wiffle Ball Contest on December 11, 2012.
e. Contestants must be present at the Appearance to win the grand the prize.
f. Prize winners must execute and return any required affidavit of eligibility and/or liability/publicity release at the Appearance or as otherwise directed by Station or prize will be forfeited and Stations may elect not to award the prize to an alternate winner. Prize(s) will be awarded only upon confirmation of eligibility and completion of all requisite releases. Contestants will not be eligible to participate in the competition to be selected as a Qualifier if the contestant has not delivered the required affidavit and release prior to that portion of the Contest. If a potential contestant or winner cannot be contacted, fails to sign and return the required fully-executed affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner's full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station's market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.
b. Participation in the Contest and/or acceptance of prize constitutes entrant's and/or winner's (and guest's, if applicable) permission for the Station or its agents to interview the winner(s) (or guest(s), if applicable), to photograph, film, and record each winner (or guest, if applicable), and to use in commerce and in any media his/her name, address (city and state), biographic information, likeness, photograph, audio or video recording, and/or any statements made by him/her regarding the Station, the Contest, and/or its sponsor(s) for purposes of trade, publicity, or promotion without notice or additional compensation, except where prohibited by law. Each winner (and guest, if applicable) agrees to sign a publicity release confirming such consent prior to acceptance of the prize, except where prohibited by law.
c. Participation in the Contest and/or acceptance of prize constitutes entrant's and/or winner's (and guest's, if applicable) agreement to release, discharge, and hold harmless the Contest Entities and each of their respective parent, subsidiary and affiliated entities, their advertising and promotional agencies, prize suppliers, and participating sponsors, and their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns (collectively, "Released Parties") from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Contest, including, but not limited to, personal injury, death, or damage to or loss of property, which may occur in connection with, preparation for, travel to, or participation in the Contest, or possession, acceptance and/or use or misuse of prize or participation in any Contest-related activity, including but not limited to any claims based on publicity rights, defamation, or invasion of privacy and merchandise delivery.
d. If for any reason this Contest cannot be executed as planned, including but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Contest Entities that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Contest, or if the Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate, suspend, and/or modify the Contest. If the Contest is terminated before the original end date, the Station reserves the right, in its sole discretion to, to modify the procedure for selecting winners, unless the nature of the event giving rise to such termination renders it impossible to select winner(s).
e. The use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by the Contest administrator. The Contest administrator's computer or telephone system is the official time keeping device for this Contest. As applicable, entries will be deemed made by the authorized account holder of the email address or mobile account submitted at the time of entry. For online entries, the authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning the email address or the domain associated with the submitted email address. For phone or mobile entries, the authorized account holder is the natural person who is assigned to the text or mobile telephone number by a telecommunications provider, or other organization that is responsible for assigning such numbers. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station's website. Failure to comply with the rules of the Contest may result in an entrant's disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a contest, the Station reserves the right to disqualify that entrant from entering and/or winning this and future Station-administered promotions and to prosecute and seek damages to the fullest extent permitted by law.
f. The Station reserves the right to make changes in the rules of the Contest, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Contest Entities, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel, terminate, suspend, or modify the Contest and shall not be required to award a substitute prize.
g. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering, or the administration of the Contest or in the announcement of a prize; (ii) incorrect or inaccurate entry information, human error, failure, or omission; (iii) lost, stolen, mangled, misdirected, postage due, illegible, incomplete, or late entries; (iv) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems or for telephone service outages, delays, busy signals, poor signals or signal interference, accidental disconnection, equipment malfunctions, and any other technological difficulties that may prevent an individual from completing his/her telephone call or submitting a text message; or (v) any cancellations, delays, diversions, or substitutions or omissions whatsoever by any transportation providers or any other persons or entities providing any services to winner(s) (and guest(s), if applicable) including any results thereof such as changes in services or location necessitated by same. Further, the Released Parties are not responsible if any part of a Contest prize that cannot be awarded due to acts of god, acts of war, natural disasters, weather, acts of terrorism, or other factors beyond the Released Parties' control.
h. For the official rules, send a self-addressed stamped envelope for receipt by December 11, 2012 to WXYT-FM Promotions Department Rules : Stoney and Bill's Wiffle Ball Contest ,26455 American Drive Southfield MI, 48034, Attn: Promotion Rules. For the names of the prize winners send a self-addressed stamped envelope for receipt within 60 days following the end of the Entry Period to the attention of Promotion Winner Lists at the above address. In either case please be sure to specify the name of the Promotion for which you are requesting the rules or winners list. Official rules and winner lists (when completed) shall also be available during regular business hours at the main offices of the Station and shall be posted online at 971TheTicket.com.
6. PRIVACY
a. If you are accessing these rules on the Station's website or entering the Contest on said website, you are deemed to agree to the Station's website's Terms of Use Agreement located at http://detroit.cbslocal.com/terms-of-use and to the use of your personal information as described in the Privacy Policy located at http://detroit.cbslocal.com/privacy-policy/.
